J.K. Rowling and The Author's Lawsuit

Harry Potter author J.K. Rowling was told by a judge on Wednesday to settle out of court with RDR Books according to the Hollywood Reporter.

The lawsuit involves a copyright dispute in which the publisher is seeking to release a Harry Potter encyclopedia. The encyclopedia was created based on a Web site created by librarian Steven Vander Ark.

U.S. District Judge Robert Patterson Jr. said the case was a “legal close call” and added, “I think this case, with imagination, could be settled.”

Imagination indeed!

    It’s unfair that she should have to “settle” anything. Harry Potter was HER idea, SHE did the work, SHE wrote the book, therefore anything that has to do with Harry Potter in any way should either A) be run by her first or B) she should profit from.
    RDR Books and Vander Ark are scum for trying to profit off her hard work. They should at least have had the decency to ask her permission and if she said no they should have dropped the project. Vultures. Leeches.

    She is a very talented woman…I can see why she might be upset….especially after all of the work she put into this….I think she said 13 years….and the encyclopedia she is writing she said will be full of stuff that is not in the books..stuff she omitted…. :)

    She owns the right to her creation and HP Lexicon is trying to cash in on it. Not to mention when Rowling publishes the HP Encylopedia she plans to publish FOR CHARITY, this could hurt its sales. It shouldn’t be a close call. She owns Harry Potter. She can tell them to stop.

    The people who are trying to publish the encyclopedia have similar information on a website, with which she has had no problem. Apparently the published product would be a lot of word-for-word copying of her original material and doing that for profit, without the author’s consent, is just wrong.

    I’m a big potter fan, I own all seven of the books, and have read them multiple times, but up to #7:
    J.K. clearly “borrowed” the concept of Hogwarts and several of the main characters from “The Worst Witch”.
    A seceret castle of magical education, hiddin in the mountains, surrounded by a restricted forest.
    There is even a mean potions teacher who detests the heroine of the book, and favors the blonde rival of the character, who I might add also hails from a prominent wizarding family.
    The main characters themselves are strikingly similiar.
    I also might add that “The Wost Witch” was written in 1974, long before J.K. even began writing Harry Potter.
    The similiarites are undeniable.
    So before you go spouting that JK should have complete control over Harry Potter, consider the fact that many of her ideas quite possibly weren’t even her own.
    Keep in mind that may things in the book aren’t her own original creations: Giants, Wands, Dragons, Goblins, Elves, Vampires, Flying Broomsticks… The list goes on and on.
    Also remember that her descriptions of many of these things are so brief and broad, that we essiantly are given a small descritpion and are left to are own imagination to fill the gaps.
    It has proven to be a great method, but she hardly owns the “right” to anything excluding characters, names and places.

    Don’t get me wrong, I’m a huge fan, and JK is brilliant, but a fan making a companion book is not going to infringe on her sales
    at all.
    Reading several of her interviews has lead me to believe she is as greedy as Dudley Dursley. If fans want more Potter and she isn’t going to supply the demand, what other motive could drive such a bitter reaction then greed?
    And yes I’m aware her own book will be published in 2-3 years, but in what way does this effect her? In no way at all
