'Tosh.0' Production Assistant Mistakenly Shot & Killed by LA Sheriff Deptuty

A production assistant from the Comedy Central series Tosh.0 was mistakenly shot and killed by a member of the Los Angeles County Sheriff’s Department.

The staffer, whose name was John Winkler, was mistaken for a stabbing subject and was fatally shot after deputies responded to an “assault with a deadly weapon, man with a knife call at an apartment complex in West Hollywood on Monday night,” according to the Sheriff’s Department (via The Wrap).

Deputies were directed to an apartment where they were told that the suspect was a thin white male who was wearing a black shirt. When they arrived at the apartment, the door opened and a man lunged out with John following closely behind. He met the description of the suspect so three deputies fired their weapons at him. It was then that they heard more commotion coming from the apartment and the real suspect was seen attacking another victim.

We send out thoughts and condolences to John‘s family during this difficult time.

something has to change @ 04/10/2014 at 6:47 pm

we need to change what is happening here. They are killing ppl all over the place and getting away with it. how can this be? this gov’t needs to get ahold of itself and take control of this out of hand situation.

Three police officers fired at him?? Did they even check if he was armed? Or their first instinct was to kill a man who fit a general description of a “thin white male with a black shirt”. Feel really sorry that an innocent man has lost his life through their mistakes.

I always hate when people say that police are horrible. But after this truly disgusting story I get where they come from. Police get away with murdering innocent people everyday. The only difference between them and a murder is somehow someway they are excused from the title and the jail time. Something truly does need to change or it could one of us next.

What the whaaaaat?? Total & utter incompetence on the police part.

No.1; Oh yeah. A big change is coming, for sure…

Trigger happy cops, and why not? They will be cleared as always in our new Police State. Could he have been your son Obama?

if you all don’t like what is going on then vote!!

Do you REALLY need to put this online, JJ? It’s disrespectful to his family and friends – posting a story during their time of grief. Shame on you and your inability to respect this incredibly hard time of the people who cared and loved him.

They just reported this on our news here in Seattle. This young man was from our area, only 30 years old, and had moved to L.A. to pursue a career in the entertainment industry. According to our news, he ran into the apt. to save his friends who were getting stabbed. He was getting attacked himself and ran out the door – and that’s when the cops mistakenly shot him. What a terrible story … he was a completely innocent victim … and a hero for trying to save his friends.

@reality: That’s the stupidest comment. These are not policies one should vote on. Cops shouldn’t kill innocent people is beyond politics.

Three cops and they couldn’t simply detain him? A thin guy versus armed and suited police? ridiculous.

American police… Shoot first ask questions later

I don’t say things like this often, but I hope those Police officers rot in a cell. Shame on them.
