Awwww…Drumpf’s been deserted by another buddy, y’all. Now Carl Icahn has quit his advisory role…BUT…only because he thinks it’s in Drumpf’s best interests…not because the blow back from this week has been turned the orange one purple. Right. Of course that’s why…

Billionaire Carl Icahn steps down as adviser to President Trump

He said in a letter to Trump that he was stepping down with the president’s “blessing” and “because I did not want partisan bickering about my role to in any way cloud your administration.”

Icahn has been criticized by Democrats who said his advisory role created a conflict of interest because he had not taken a formal government job and was still running his businesses.

In March, Icahn told CNNMoney that the those allegations were “absurd” and “completely ridiculous.” He added, “I don’t talk to Donald that often.”

Exactly what prompted Icahn’s decision to step away from his informal White House role was not immediately clear Friday.

Neither the White House nor Icahn Enterprises, his massive investment company, responded to requests for comment.

In fact, Icahn laments in his letter that he didn’t have more time to discuss policy with the president.
“I sincerely regret that because of your extremely busy schedule, as well as my own, I have not had the opportunity to spend nearly as much time as I’d hoped on regulatory issues,” Icahn wrote.

Icahn also mentions that he’s “received a number of inquiries over the last month” into whether his advisory role overlapped with the duties of Neomi Rao, who Trump named as the administrator for the Office of Information and Regulatory Affairs in July.

Icahn asserts those are baseless concerns: “The answer to that question is an unequivocal no,” he wrote. He also expressed support for Rao.

“While I do not know Ms. Rao and played no part in her appointment, I am confident based on what I’ve read of her accomplishments that she is the right person for this important job,” he said.

Icahn formed Icahn & Co in 1968, and the firm took significant stakes in numerous major corporations over the years, typically proposing changes in the way they were run or urging them to sell off divisions. Icahn was one of Trump’s earliest backers on Wall Street

Trump said Icahn is the type of person he wanted in his administration early in his campaign. He told MSNBC’s “Morning Joe” in June 2015 that he’d “love to bring my friend Carl Icahn” as Treasury secretary. It was a suggestion that Icahn quickly declined.

Instead, Trump tapped Icahn to serve as a special adviser on regulatory reform in December.

PT, GC and WB&TJ here’s the Libération article. PT, yeah I thought about just doing a summary of it when I saw how long it was, but I didn’t want to give the rabids who are just waiting to trash Brad no matter what, another excuse to take things out of context just to stomp on him so I decided to post the whole thing.

“Brad Pitt ruined my business and took credit for my work”

Visual artist Odile Soudant, who just sued the star, is demanding copyright recognition for her creations at château Miraval.

The legal decision had stayed confidential until now. April 19th, the Paris Court of Appeals sentenced one of Brad Pitt and Angelina Jolie’s companies to pay 565 000 € to French visual artist Odile Soudant, including 60 000 € for damage to her image and reputation. At the center of the dispute: the numerous lighting installations done at Miraval, the couple’s, now separated, Var property. A legal procedure started in the summer of 2014, when the artist was suddenly taken off the job after 3.5 years of work, keeping her from finishing the work.
In their decision, the judges underline the “breaches” of the company Château Miraval and sentence its owners to pay the 300 000 € of unpaid bills. “A first victory”, Odile Soudant, who had never before talked about this collaboration particularly because of a strict confidentiality agreement, is pleased to say. “Brad Pitt ruined my business and took ownership of my work”, she tells Libération today, ready for a show of force. Because another fight is brewing over the ownership of Miraval’s installations, claimed as his by the actor himself. Facing the wronged artist, an armada of American lawyers defending the star’s interests.

    A mythical place

Legend has it that it’s while flying over the region in a helicopter that the couple fell in love with this 17th century Provencal estate in Correns, Haut-Var, in the middle of vineyards and a hundreds of hectares park.
A mythical place since Pink Floyd recorded their album The Wall there in 1979. After leasing château Miraval for 2 years, Brad Pitt and Angelina Jolie were able to convince its owner, a rich American businessman, to let them buy it in 2008 for an estimated price of 45 million euros. The home is perfectly habitable but not to the couple’s taste, who want to make it a home base for their 6 children, and will throw themselves in monumental renovations. The structural work is entrusted to a regional architecture firm, who already know the property after having done work there in the past. A decorator is hired to work alongside. But more than materials and lining, Brad Pitt is especially fond of natural light, that he wants to make the most of. Passionate about architecture, the actor is an unconditional fan of Jean Nouvel, to the extent of naming one of his daughters Shiloh Nouvel. It’s incidently for this reason that he will get in touch with Odile Soudant at the end of 2010.

Renowned visual artist, she created and managed the “Lumière” department of Jean Nouvel’s architecture firm for 10 years, where she dealt with numerous large scale worksites. At the head of the company Lumières Studio, created in 2009, she designs and manages the lighting in architectural projects, events and artistic projects like the Anish Kapoor and Anselm Kieffer expos at the Paris Grand Palais.
The first meeting with Brad Pitt took place in December 2010, at Miraval. “He wanted to make it an exceptional place and thought that light should be at the center of everything”, says the artist, who has “carte blanche” to light four buildings on the property including the château, which in itself has about 40 rooms. No contract is signed. Every month, Odile Soudant bills artistic conception fees while her company handles the technical studies and set up of the installations.

In Paris, Lumière Studios quickly becomes a gigantic lab, where prototypes are developped before being installed. Each fixture, tailor-made, is the result of particularly in-depth studies requiring the fabrication of precise plans and models.
Month after month the “BP project” requires more and more expenses. The artist manages architects, designers and lighting engineers, acousticians and even a physical optics engineer to calculate the angle of light rays reflecting on the home. Up to 17 people work full-time.

For more than 2 years the work goes on without any problems. The client is thrilled and every bill is payed in cash. As often happens on large worksites in the Var, numerous companies gravitate around Miraval. When the first difficulties arise in the spring of 2013, more than 25 million euros have been spent on the work. Technical problems pile up at the worksite and the relationships become more and more tense between the different parties, who blame each other for the delays.

In early December, Brad Pitt makes enquiries about the financial impact of the construction work. It’s there that the story turns. In his reply, the project management assistant totals all the fees billed by Odile Soudant and her company at 4.9 million euros. The Paris Court of Appeals will prove that this amount is far superior than the services actually billed by the visual artist. Just like the judges will deem that the worksite delays are entirely the project manager’s fault and not the visual artist’s. But this email sparks things off. “It’s criminal”, replies Brad Pitt right away. “No more additional payment.” Odile Soudant is then unaware of this exchange, that she will learn about only 2 years later during the legal proceedings. She can’t even imagine such a veto, given that the actor continues to call her to the worksite as if nothing happened. “Odile, I need you”, he insists in early January. “Come, please. I need you to finish.”

    “Don’t sue”

From then on, the artist will find herself at a complete financial impasse, receiving no other funds, all while having to make the necessary expenses to pay her employees and suppliers. “Brad, we’re working 24 hours a day but we practically stopped orders 3 days ago because of the lack of money. We haven’t been payed since December 15th.”, she warns in February. The situation is especially critical because by then her company depends 70% in part on orders from Château Miraval, which demands that the Miraval site take absolute priority. Hassled by her subcontractors and unable to pay her own expenses, Odile Soudant ends up putting the company on notice. Brad Pitt’s reply arrives 10 days later by email. “I don’t know how things go in France, but in the US friends don’t sue friends.”, the actor taking offense. “I have been nothing but a fan of your work. Don’t sue. Let’s finish the project and be proud of it. The work is too good to leave on a bad note. Life is too short, my friend.” A short time later, he’ll deliver another piece of advice: “Don’t waste your time on legal proceedings. Follow your artistic path and don’t worry about the rest.”

An incomprehensible schyzophrenia for Odile Soudant, whose company is now in ruins. “My company and my bank accounts are well beyond the maximum allowed”, she warns again. “I can’t use my bank card anymore. My company is going under. I’m not asking you to pay it all, but at least part of it. The suppliers and subcontractor need to be paid. I don’t know how to make you understand the urgency we’re in right now. Without a quick solution, the consequences will be catastrophic for both of us.”
“I authorized a payment yesterday”, Brad Pitt replies the week after. “I’ll be at Miraval from Monday to Wednesday if you need me.”
But Odile Soudant, who’ll receive only parts of the funds months later, will not be allowed to come back to the worksite. Worse yet: Château Miraval will hire one of her ex employees to finish the installations in her place, actions liable to legal pursuits for counterfeiting.

    The last Guerlain campaign

It’s the start of a long descent to hell for the visual artist, who sees certain suppliers turn against her. Outstanding debts also lead to important deferments with URSSAF, keeping her company from being able to take on new business offers in the public market. Put in bankruptcy, Lumière Studio soon shows a debt of 800 000 €. It’ll take 3 years for justice to give her just cause. But another front worries the Hogan Lovells lawfirm, charged with protecting Brad Pitt’s interests around the world, today: the copyrights associated with the installations at Miraval. Works that the actor now claims ownership of, as his lawyers repeated to Libération. “The lighting ideas came primarily from Mr. Pitt himself, who is passionate about architecture and knows what he wanted to achieve.”, testified the worksite architect in a testament opportunely given to the court the day before the hearing. “If it’s true, then I’m a Hollywood actress”, says an annoyed Odile Soudant, who to the contrary considers her works to be original creations and exclusives, as such protected by copyright. “No right was conceded”, she insists.

To avoid all pusuit on intellectual property, Brad Pitt’s defense also established that château Miraval was a “purely private” property, and that therefore copyright could not be invoked. Except for one thing however: the last Guerlain commercial, directed by Terrence Malick. We see Angelina Jolie strolling around the property, hair in the wind. In the last shot, the actress walks down a majestic staircase, bathed in a pool of light. A light fixture conceived entirely by Odile Soudant, whose lawyer just sent a formal notice to Guerlain.

  • GroundControl500

Thank you, Feline. You are an angel.

“prototypes are developed before being installed. Each fixture, tailor-made, is the result of particularly in-depth studies requiring the fabrication of precise plans and models.”

If Brad was paying for all the work that went into producing the lighting, even the prototypes and all the research, then it seems to me he owns that as well as the results. If a scientist works for Dupont and Dupont pays for all the research and efforts that went into creating a new invention done on their time then Dupont owns that invention – absent a contract which states the contrary such as a shared ownership or similar arrangement. Here, there is evidence that Brad came up with the visions and sought professional help to bring them to fruition.

Considering that Soudant didn’t even finish up the project – for whatever reason – then it would be much more difficult to claim artistic ownership?

“To avoid all pursuit on intellectual property, Brad Pitt’s defense also established that château Miraval was a “purely private” property . . . therefore copyright could not be invoked. Except for one thing however: the last Guerlain commercial . . . ”

If a celebrity is paid to be interviewed or filmed in their house the house doesn’t lose residential or private status. And for filming purposes I assume Malick used a professional cinematographer, as in Christian Berger, who lit the film. Soudant did not light the film. Of course, this is not my area.

” . . . totals all the fees billed by Odile Soudant and her company at 4.9 million euros. The Paris Court of Appeals will prove that this amount is far superior than the services actually billed by the visual artist. Just like the judges will deem that the worksite delays are entirely the project manager’s fault and not the visual artist’s.”

The billing was still by Soudant’s company. Is she suggesting she’s not responsible for that?

  • Observer2

Thanks, Felinelilly! I’m doing the wave for you.

So, the did the asst. project manager give Brad the wrong figure? It seems like it was the project manager that may be at fault> And Brad said he OK’d the payment. Was the project manager the one who was responsible, than to pay her? And they didn’t? I’m confused by the huge disparity between what Brad was told they billed vs. what they actually paid her through the settlement. What did the subcontractors charge her for the work vs. what she was charging?

And how can she expect full payment if she didn’t finish the job and was this ex employee of hers hired by the project manager or by Brad? And who does she know if she hasn’t seen the final project?

And it’s interesting that she’s only giving out Brad’s replies, yet, we don’t know what he was actually, responding to.

She’s being sparse in her communications.

And what happens to her for breaking the confidentiality agreement?

You know his ego can’t take any of this. He’s pretty much hated and a laughingstock around the world. That’s why he does those stupid rallies, they’re his binky. LOL

  • Lady Valeria

The argument about Mirval/Guerlain is stupid. Even if Brad/Angelina were paid to use their home in the commercial…….it doesn’t suddenly become a commercial or public place. And even then…….Angelina donated her entire fee. And unless I’m a total dodo bird right now……unless she holds all the necessary copyrights and Brad started selling the whatever lighting thing…….why does it matter the “lighting” was being shown in a commercial?

And yeah the thing about $. It says the project manager gave out the wrong figure to Soudant? She billed/was or is in the hole for 800k, but the manager said it was 4.9 million? Wtf is that? I am honestly wondering/thinking if the guy was cheating both of them and either Brad thought something was up on her end and wouldn’t pay more (she doesnt specify specific amounts… was she relying on other people to tell him how much $ or did she specifically tell him?) he did authorize more $ and the project guy “managed” it.

IMO of course. But we don’t know if Brad is taking that guy to court, etc. He could be. I would look into it, if I was him.

  • Observer2

So, there was a free-speech/alt right rally today in Boston at Boston Commons and the protestors shut them out and down.

Protestors against hate, bigotry, white supremacist totaled approx. 40K. The alt right, about 2 dozen. LOL

Two high profile alt right/hate group leaders dropped out because they didn’t want to be associated as haters/white supremacists. They seemed to be proud of it last weekend. Assholes. Wimps. Wassholes.

  • Lady Valeria

Yeah. …..if she didn’t finish the project……why didn’t she yank the designs? I am thinking that they were all a team, etc, contributing with Brad having the ownership of it. Otherwise she would’ve yanked them. I mean it ducks but that’s how it works. I assume she knew that.

And why no contract? That’s odd on both their parts but particularly amateur for her. He could stop paying at any time. That’s bad business sense IMO.

  • toastie postie

I think she was being screwed by those under her – that’s on her.

  • GroundControl500

Maybe I read it wrong but I though that Soudant billed in 2 parts – for her “vision” work and for the team she hired to work on the project. And that the team’s billing was way higher than her personal work. But I came away thinking it was all her company because that’s why she claims to have lost her business – because all these people she hired to work on the project cost her so much. Which is, of course, why you need a contract for work especially when you take it upon yourself to expend enormous sums of money without specific prior approval.

  • GroundControl500

I wonder if she also failed to secure contracts with her subcontractors. She seems to have made a fortune off Brad. Stupid of her not to keep him updated on the expenses she was incurring on his behalf. Even if he seemed uninterested you should make sure they are made aware.

  • GroundControl500

    All good questions, O2. 🕵🏼

ETA when there is a lawsuit aspects of confidentiality agreements get broken. What she revealed may have all been part of the court record. She gets to disclose that. If one of my clients were to ever be stupid enough to go after me for ineffective assistance I can reveal previously undisclosable attorney client communications to the extent I need to in defending my work or countering his claims.

  • Lady Valeria

Nosy me I am also wondering if this had an effect on leading towards the divorce…..that seems to be stressful on all parts.

I see what you mean about the bills. So she basically is saying she personally wasn’t paid for her “vision”. Hmmmm. I’m thinking that ties in wit the no contract thing which is super dumb on her part. Maybe it was something informal and kind of blew up? I honestly don’t get it.

EDIT: reread and responded up one.
