Judge Orders Special Prosecutor to Investigate Jussie Smollett Alleged Attack Case

A judge is now looking into Jussie Smollett‘s controversial short-lived prosecution after being charged for allegedly falsely reporting an assault in Chicago, Illinois.

Cook County judge Michael Toomin appointed a special prosecutor to investigate the prosecution of Jussie on Friday (June 21), which “may have been legally invalid from the very beginning” according to The Chicago Tribune.

The judge ruled that State Attorney Kim Foxx had the right to withdraw herself from the prosecution but “held no legal authority to delegate that responsibility to her top deputy.”

“There was no master on the bridge to guide the ship as it floundered through uncharted waters, and it ultimately lost its bearings…the unprecedented irregularities identified in this case warrants the appointment of independent counsel to restore the public’s confidence in the integrity of our criminal justice system,” he said.

They will investigate “the actions of any person or office involved in all aspects of the case.” It will be possible to re-charge Jussie, or bring an “indictment against anyone else if there are reasonable grounds to do so.”
