New York Judge Upholds Defamation Ruling Against Kesha in Dr. Luke Legal Battle

There’s been an update in the ongoing legal battle between Kesha and her former producer, Dr. Luke.

In February 2020, New York Supreme Court Judge Jennifer Schecter ruled that Kesha had defamed the producer by publishing a series of texts between herself and Lady Gaga that claimed Dr. Luke had drugged and raped Katy Perry.

Kesha‘s legal team attempted to appeal the decision, but the courts ultimately upheld the ruling on Thursday (April 22), per Page Six.

Fiona Apple Calls Out Grammys for Nominating Dr. Luke After Kesha's Allegations

Fiona Apple is calling out the Grammys.

The Fetch the Bolt Cutters singer-songwriter spoke out against the Recording Academy in an interview with The Guardian regarding its treatment of ousted president Deborah Dugan and nomination of Dr. Luke at the 2021 Grammys.

“I’m waiting to hear more about what Deborah Dugan has to say because that all reeks to me. When you hire somebody and they raise questions and then they get fired? There’s a lot of things that she brought up that make it so that I can’t vet that situation and I don’t really wanna go there and support it,” she said of Deborah Dugan, who alleged sexual harassment and a “boy’s club” culture in her legal complaint of the Grammys’ nomination process before being ousted.

Fiona also called out the organization for nominating Dr. Luke, or Lukas Gottwald, who is nominated for his work with Doja Cat (“Say So”) under the new pseudonym Tyson Trax as well.

Although he has defeated several Kesha-related lawsuits against him regarding allegations of abuse, he has ongoing defamation and breach of contract cases against Kesha, and her allegations led him to work under different names.

“They had [Kesha] up there singing ‘Praying’ and now they’re gonna go: ‘Oh, but it’s Tyson Trax!’” Fiona said of the organization.

“I keep going back to them putting Kesha on stage like, ‘We believe you’ — and I believe her — then two years later, f–king Tyson Trax…not to go back to that word, but it’s bulls–t,” she continued.

“I don’t know if anybody who’s nominated can help having the thought: What would I do If I won? My vision was that I would just get up there with a sledgehammer and I wouldn’t say anything, I would take the Grammy and smash it into enough pieces to share and I would invite all the ladies up. My second thought was I wonder if I can get all these ladies to boycott this s–t because of Dr. Luke.”

Back in 2017, Katy was deposed in Kesha‘s battle against the producer, in which Kesha accused Dr. Luke of rape. At the time, Katy said she was afraid of being publicly attacked for being “the one woman that is against women” if she took a public stance.

“I knew both of them at the time. It sucks when you know both of the players. I can only speak for my own experience, and my own experience [with Dr. Luke] was a healthy one. I believe in due process. And I also believe that only they know the truth.”

She also spoke out about her defense of Ellen DeGeneres.

Judge Rules Kesha Defamed Dr. Luke by Claiming He Raped Katy Perry

Kesha has been in the middle of a legal battle with Dr. Luke for years now and he just scored a victory in his case against her.

Dr. Luke sued Kesha for defamation over a claim she made that he raped Katy Perry while texting with Lady Gaga.

Katy was deposed and she denied that she was ever raped by Dr. Luke. Now, a judge has ruled that Kesha defamed the music producer because of the publication of this text message.

“Kesha made a false statement to Lady Gaga about Gottwald that was defamatory per se,” Manhattan Supreme Court Justice Jennifer Schecter wrote in a decision Thursday (via Page Six). “There is no evidence whatsoever that Gottwald raped Katy Perry. Moreover, publication of a false statement to even one person, here Lady Gaga, is sufficient to impose liability.”

A jury must now decide at trial if Kesha defamed Dr. Luke.

The judge also ordered Kesha to pay Dr. Luke over $373,000 in interest because she was late in her payment of $1.3 million in royalties to the producer. Her counterclaim that served as her request to be released from a contract with his record company was rejected.

“Dr. Luke is pursuing this lawsuit to seek recovery for the serious harm Kesha’s false accusations of rape have caused Dr. Luke, his family and his business,” his lawyer Christine Lepera said in a statement. “Dr. Luke looks forward to the trial of his case where he will prove that Kesha’s other false statements about him were equally false and defamatory.”

Kesha had previously sued Dr. Luke for alleged sexual and emotional abuse, but she dropped her case.

Katy Perry & Co-Defendants Owe $2.78 Million in 'Dark Horse' Lawsuit

Katy Perry was sued for copyright infringement over her song “Dark Horse” and a jury decided that she and her co-defendants had copied the song from Flame‘s “Joyful Noise.”

Now, Katy, producer Dr. Luke, record label Capitol Records, and others are on the hook for a combined $2.78 million in damages, according to THR.

The bulk of the money will come from Capitol Records and Katy owes just over half a million dollars. The money will go to songwriter Marcus Gray and his co-plaintiffs.

Katy‘s lawyers have filed a motion for the judge “to rule that no reasonable jury could find copyright infringement based on the evidence presented at trial,” which could eliminate the damages.
