Tracy Morgan Faulted by Walmart for Not Wearing Seatbelt During Car Crash

Tracy Morgan is being faulted by Walmart for not wearing a seatbelt in the six-car accident that left him severely injured and killed his friend, comedian James McNair.

The 45-year-old 30 Rock actor is among several people who were injured in the crash and are suing Walmart for negligence as their truck driver was fatigued at the time of the accident.

In a response to the New Jersey federal court filed on Monday (September 29), Walmart said that the injuries “were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seatbelt restraint device,” according to The Hollywood Reporter.

“By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs’ own best interests,” the response continued.

Tracy Morgan Is Still 'Struggling' - Get the Latest on His Recovery

Tracy Morgan‘s lawyer has provided another update on his recovery and says that the comedian is still “struggling” following the fatal car crash he was involved in back in June.

“He’s really having a tough time,” the 45-year-old 30 Rock actor’s New York lawyer Benedict P. Morelli told People.

In the crash, Tracy suffered a broken leg, several fractures to the face, and traumatic brain injuries. He was kept in a rehab facility until mid-July and his since been undergoing at-home therapy. While he has been spotted using a walker, Tracy still relies on a wheelchair and he may not be able to fully walk again for months.

“He’s making incremental progress,” the lawyer added. “But they’ll have to wait another month before they assess him cognitively.”

Tracy Morgan Looks to Be in Great Spirits in First Post-Accident Appearance (Video)

Tracy Morgan seems in good spirits in this first post-accident appearance on Monday (July 14) at his home in New Jersey, caught on tape by Entertainment Tonight.

The 45-year-old funny man walked to his car with the aide of a walker and hoisted himself up to look at the cameras before saying, “I’m okay, I feel strong.”

“Love you. Thank you very much. Appreciate it,” Tracy added.

Tracy Morgan Released From Rehabilitation Center One Month After Car Crash

Tracy Morgan has been released from a rehabilitation center and has been cleared to go home to continue recovering after his deadly car crash in June.

“He asked me to pass along his sincerest gratitude to everyone who has helped him get to this point,” the 45-year-old actor’s rep shared in a statement. “He would also appreciate some privacy during this crucial point in his recovery.”

In case you missed the news, Tracy has decided to file a lawsuit against Walmart for negligence, allowing their employee to drive without sleeping for 24 hours and causing the crash.

Tracy Morgan Sues Wal-Mart Over Deadly Car Crash

Tracy Morgan is suing Wal-Mart over the New Jersey car crash that he was involved in last month.

The 45-year-old actor filed a lawsuit for Wal-Mart’s carelessness and allowing their employee to drive after being awake for more than 24 hours.

“As a result of Wal-Mart’s gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages,” the complaint stated. “Walmart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries.”

Wal-Mart responded by saying, “This has been a terrible tragedy. We wish Mr. Morgan, Mr. Fuqua Jr., and Mr. Millea full recoveries. Our thoughts continue to go out to them, their families and friends, as well as to the families and friends of everyone involved, including Mr. McNair, who lost his life. We are deeply sorry that one of our trucks was involved. As we’ve said, we’re cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved.”

Tracy Morgan Released from Hospital, Enters a Rehab Center
