Supreme Court Votes to Strike Down Roe V. Wade Abortion Rights Ruling in Early Draft – See the Reactions

The Supreme Court is potentially striking down a historic decision.

The court voted to strike down the Roe v. Wade decision in an early draft majority opinion written by Justice Samuel Alito, which was obtained by Politico.

The draft opinion is described as “a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights.”

“Roe was egregiously wrong from the start,” Alito writes in the document.

“We hold that Roe and Casey must be overruled…it is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

It is worth noting that Justices sometimes change their votes as draft opinions circulate. The court’s holding will not be final until it is published, likely sometime in the next two months.

The ruling, if published, would end federal constitutional protection of abortion rights and allow each state to decide whether to restrict or ban abortion. See the leaked document.

A person familiar with the court’s deliberations said four of the other Republican-appointed justices – Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – voted with Alito. Three Democratic-appointed justices – Stephen Breyer, Sonia Sotomayor and Elena Kagan – are working on “one or more dissents,” according to the person. How Chief Justice John Roberts will ultimately vote is still unclear.
