Amber Heard Accuses Johnny Depp of Sexual Assault in Defamation Trial's Opening Statements

Amber Heard and Johnny Depp‘s defamation lawsuit is underway.

The former couple’s lawyers made their opening statements on Tuesday (April 12) in Fairfax, Virginia, painting very different pictures of their troubled marriage.

Johnny sued Amber in 2019 over an op-ed published in the Washington Post, in which she alluded to allegations she had made against him in the past and said she had become “a public figure representing domestic abuse.”

Johnny responded with a $50 million dollar claim, though Amber did not name Johnny in the piece or detail any of the alleged abuse. She subsequently filed a $100 million counterclaim.

According to Rolling Stone, Amber‘s legal team claimed in their opening statements that the Pirates of the Caribbean star “sexually assaulted” the actress towards the end of their relationship, an allegation that had never been made publicly before.

Her attorneys described “a three-day blackout in which he abused and sexually assaulted Amber.” They added, “You will hear in the most graphic and horrifying terms about the [sexual] violence that she suffered. You’ll hear that straight from her.”

However, Johnny‘s lawyers alleged that Amber was a “a profoundly troubled person” who, despite claiming to be a victim, was a perpetrator of domestic violence. The team added: “The only medical report of an injury during their relationship was a severe one sustained by Mr. Depp after an argument shortly after their marriage, while the couple was in Australia … She threw a vodka bottle at him that hit his hand and exploded, severing the end of one of his fingers.”

They also questioned the timing of her sexual assault allegation, suggesting it was weaponized to strengthen her defense and taking aim at her credibility.

“Ms. Heard had never made that accusation against Mr. Depp — it was never part of her allegations of abuse in 2016. So, what changed? When she realized the seriousness of what she alleged [about being the victim of domestic abuse], she panicked and alleged sexual assault,” one lawyer told the jury. “In Mr. Depp’s fifty-eight years, not a single woman has ever accused him of violence, and nobody in Hollywood or the world had any reason to believe he was an abuser – until Ms. Heard publicly accused him.”

The Aquaman actress’ attorney attributed the salacious nature of the trial to Johnny. “It’s not about which party can sling more mud,” he said. “But you’re going to hear a lot of that in this trial. You’re going to hear that because that’s what Mr. Depp wants to turn this case into. He wants to turn this case into a six-week-long public spectacle of the most intimate aspects of their relationship and their marriage.”

Johnny’s lawyers shared their plans to call on a number of witnesses, including police officers who responded to the 2016 incident. “The evidence will show that six days after Mr. Depp’s request for a divorce, and three days after Ms. Heard’s lawyer threatened Mr. Depp with claims of abuse if he did not agree to her financial demands, Ms. Heard arrived at the courthouse in Los Angeles, California, to file for a restraining order for domestic abuse,” they said. “You will hear from police officers who responded to a 911 call on May 21st, after Mr. Depp left, and saw no injuries on Ms. Heard. Nor did the police officers see any of the property damage Ms. Heard claims Mr. Depp caused on his way out; and you will hear that those officers determined there had been no violence and no crime.”

This latest lawsuit comes after Johnny sued The Sun for an article that claimed he was a “wife beater.” The outlet ultimately won the case in 2021.

Over the weekend, Amber announced that she would be taking a break from social media ahead of the trial.
