Kelleth Cuthbert, the model who became an internet sensation known as FIJI Water Girl, is suing the brand that helped make her famous.

The model, whose real name is Kelly Steinbach, filed a lawsuit alleging that the company “intentionally created cardboard cutouts of [her] for use in a cardboard cutout marketing campaign,” according to The Blast.

Kelleth says that she never gave her authorization to use her image in the campaign and one day after the cutouts were created, Fiji tried to negotiate with her agent. Without an agreement being signed, the cutouts were already spotted in Los Angeles, including in paparazzi shots of John Legend shopping at a grocery store.

The lawsuit alleges that Fiji tried to use Kelleth‘s image to make a profit, even though they allegedly were aware that no agreement was in place. She is suing for monetary damages and to get the cutouts removed.

FIJI Water responded by saying: “This lawsuit is frivolous and entirely without merit. After the Golden Globes social media moment, we negotiated a generous agreement with Ms. Cuthbert that she blatantly violated. We are confident that we will prevail in Court. Throughout our history, we have had a sterling reputation working with talent.”

The Golden Globes were only a few days ago, but viral sensation Kelleth Cuthbert – aka FIJI Water Girl – already has cardboard cutouts at stores!

John Legend was photobombed by the cut-out while grocery shopping on Thursday afternoon (January 10) in Beverly Hills, Calif.

Kelleth became an internet phenomenon this week when she was photographed standing behind celebs on the red carpet at the Golden Globes while holding a tray of FIJI water bottles. There was one celeb who was not happy about it though.

Jamie Lee Curtis is slamming Fiji Water for having the Fiji Water Girl (aka Kelleth Cuthbert) in the background of some of the 2019 Golden Globes photos.

The 60-year-old actress posted a photo of her with the Fiji Water Girl in the background and wrote, “So, my husband, who doesn’t look at a lot of show business news sites, just mentioned that I was on the CNN website. I specifically moved away from the blatant promotions by Fiji and Moet where young women with their trays filled with their wares stood near a designated camera.”

She continued, “I knew why there was a photographer poised there and I moved away as I said out loud that I didn’t want to be doing advertising for either. Clearly this angle shows that I moved from her being behind me and yet from the side it still happens. The sponsors of events need to get permission from people when they get them to take their picture next to products.”

Kelleth Cuthbert is the now-viral model and actress who made headlines by posing in the background of so many red carpet photos from the 2019 Golden Globes.

“We’re so glad everyone is talking about our water! *senses ominous presence* She’s right behind us, isn’t she?” Fiji Water tweeted during the Golden Globes.

Now, Kelleth is speaking about how everything went down on the red carpet and her “ominous” appearance behind some very famous celebs.

“There’s tons of photographers everywhere. It doesn’t matter where you stand, you’re in the crossfire of every shot. You’ve gotta have good face, at least, if you’re gonna be hovering in the background frequently,” she told People.

“The photographers have to take so many shots, so rapidly. Obviously, your face doesn’t look perfectly pleasant in all of them, so they captured lots of expressions [where I’m] naturally making weird faces,” she continued.

And Kelleth had no idea how viral she went until the red carpet was wrapping up!

“I felt very cut off from everything. I didn’t find out until the last stragglers of the red carpet were heading into the awards ceremony, and all these people walking by started shoving their phones in my face and showing me that I was trending on Twitter, but I didn’t understand the magnitude of it till later,” she added.

FIJI Water was the official water sponsor of the event and the brand had servers on the red carpet handing out bottles of water to all of the VIPs. Well, one of them had a very fun night by photobombing a bunch of the celebs and the photos are awesome.

Bodyguard‘s Richard Madden, Vice‘s Amy Adams, Halloween‘s Judy Greer, Bohemian Rhapsody‘s Lucy Boynton, and American Horror Story‘s Cody Fern are just some of the stars who got photobombed by the server, who is being dubbed the “FIJI Water Girl” on social media.
