The case can now move forward, according to a U.S. District Court judge, via NPR on Friday (July 17).

Judge André Birotte Jr wrote: “Mo’Nique plausibly alleges that, after she spoke out and called her initial offer discriminatory, Netflix retaliated against her by shutting down its ‘standard practice of negotiating in good faith that typically results in increased monetary compensation…”‘”

Her attorney David deRubertis said this “is an important victory for Hollywood talent who, just like all other workers, need protections against retaliation if they raise concerns about pay discrimination during the hiring process Employers in the entertainment industry need to take pay discrimination concerns seriously, fix them if the concerns have merit, and never retaliate against those who have the courage to speak up about equal pay.”

Netflix’s rep told the news outlet “we do not have anyone available at this time” for comment.

Mo'Nique Is Suing Netflix for Race & Gender Discrimination

Mo’Nique has filed a lawsuit against Netflix and she claims that the company discriminated against her when they offered her just $500,000 for a comedy special.

The 51-year-old actress and comedian, who won an Oscar for her performance in the movie Precious, launched a boycott against Netflix last year because of “gender bias” and “color bias.”

Mo’Nique says that Netflix offered stars like Amy Schumer, Chris Rock, and Dave Chappelle much more money for their comedy specials.

“The offer Netflix made Mo’Nique wreaked of discrimination; it perpetuated the pay gap suffered by Black women,” the lawsuit read. “Mo’Nique objected to Netflix’s discriminatory pay offer, pointed out how it was discriminatory and asked Netflix to do the right thing by negotiating fair pay with her. In response, Netflix did the opposite. It dug its heels in the ground, refused to negotiate fairly and stood behind its discriminatory offer.”

Mo’Nique confirmed the lawsuit on Instagram and she wrote, “Hi My Loves – I can confirm that today I filed a pay discrimination lawsuit against Netflix. I had a choice to make: I could accept what I felt was pay discrimination or I could stand up for those who came before me and those who will come after me. I chose to stand up. I don’t have any further comment at this time, but I appreciate all of your support and love.”

Mo'Nique Explains Why She Feels Betrayed By Oprah Winfrey - Watch!

Mo’Nique is opening up about why she has a problem with Oprah Winfrey.

The 51-year-old Precious star and comedian spoke out in an interview with Comedy Hype.

During her interview, Mo’Nique explained that Oprah called her and said her brother wanted to come on the show and talk about molesting Mo’Nique, and he wanted to tell other parents how to look out for molesters.

She began to see commercials for the episode with her other family members featured, including her mother, father and brother, despite the fact that she shared about her strained relationship with her mother. She was hurt that she wasn’t told in advance by Oprah they’d also be on the show.

“We didn’t discuss that, Oprah…I’m watching my father sit there, who was a strong alcoholic. I’m watching him drunk. I’m watching my mother be greedy. I’m watching my other brother, who was my manager, be greedy…I’m watching the scam.”

“I want you to understand something, see this is why me and Oprah Winfrey got a problem…until that woman says let me apologize to you publicly, it’ll be ’til the day that I leave this Earth, because what you did was malicious.”

She then sent a message to Oprah: “I would say Oprah Winfrey: you know what you need to do. And stop hiding behind what you call is negative comments…what people are beginning to do is see you for who you are.”
